比特币法律[6] (西班牙语：Ley Bitcoin, 发音：[ˈlej bitˈkojn])[7]，是一条萨尔瓦多的法律，该法律给予比特币具有法定货币性质。该法案由萨尔瓦多立法议会 在2021年6月8日订立，并在2021年9月7日正式生效[8][9] [10]。 法律条文目的是把比特币给予法定地位，是一个不受限制的法定货币，不会设立交易限额等限制。[6]

历史

把比特币视为货币已早在2019年在萨尔瓦多开始试验。 [11]萨尔瓦多沿海村庄埃尔宗特早在2019年，已是一个活跃使用比特币的社区。当地的工人会接收比特币作为工资，也可以使用比特币付款及缴付费用。[11][12]

在2021年迈阿密的会议中[13]，总统布克勒宣布将提倡立法，把比特币定为法定货币，并认为此措施可以创造更多职位空缺及解决现时的财政危机。[14]

比特币法律最终在2021年6月9日，于萨尔瓦多立法议会以62票(共84人参与投票)通过, 比特币在2021年9月7日成为该国的法定货币。[5]

评价

比特币法律被一些外界人士评为对总统有很好的“公共关系价值”，维持他年轻总统形象。但比特币的汇率太高波动性，则被受质疑是否适合为一个法定货币[14][15][16]。

国际货币基金发言人担心，比特币普及可能会增加贪污、洗黑钱、及逃税等风险。[17][18]外界也担心，比特币的去中心化性质，会导致洗黑钱更容易以及逃税更容易。[17]

在2021年8月，当地报章艺术报, 作出的一项民意调查显示，四分三市民表示不会使用比特币作为交易。[19]

实施

比特币在2021年9月7日成为萨尔瓦多共和国的法定货币 [8][9][10]。

在法例生效后首数小时，数个国家货币对换平台出现负荷过大及网站挤塞，政府也因而把其比特币钱包Chivo，暂时下架。[19]政府后来在中午左右，增加服务器的可载量并把比特币电子钱包重新上线。[5]比特币首日混作混乱，导致比特币汇价大幅波动。[20]

由于担心汇率波动问题，导致超过一千人游行示威，抗议比特币法律。[21]
