2019年美國大學錄取賄賂醜聞（英語：2019 College Admissions Bribery Scandal）是用違法違規手段幫助富裕家庭子女獲得美國幾所著名大學本科錄取的共謀犯罪（英語：Conspiracy (criminal)）事件。該事件於2019年3月12日由美國聯邦檢察官披露，至少有50人參與其中，而其中一些人已經認罪或同意認罪。33名大學申請者的家長被指控在2011年到2018年期間內向名校申請諮詢師威廉·里克·辛格（William Rick Singer）支付了超過2500萬美元；其中部分款項被辛格用於欺詐性地誇大申請者的入學考試成績並賄賂大學官員。[1][2][3]

威廉·里克·辛格（William Rick Singer）控制着參與整個欺詐計劃的兩個公司：關鍵全球基金會（Key Worldwide Foundation）和優良大學及職涯網絡（The Edge College & Career Network）。目前，辛格已經向聯邦調查局認罪並與其合作，以搜集其他共謀者的罪證。[4][5] 根據他的供認，辛格違規協助750多個家庭的孩子進入名校。[6]2023年1月，辛格被判處三年半監禁，並沒收超過1000萬美元[7]。

由美國聯邦檢察官安德魯·萊林（英語：Andrew Lelling）所率領的聯邦檢察官辦公室向麻省聯邦地區法院提起了針對威廉·里克·辛格和被他所賄賂的大學工作人員，以及被指控利用欺詐和賄賂手段以確保他們孩子被11所大學所錄取的家長們的共謀（英語：Conspiracy (criminal)）重罪訴訟；這些罪名包括郵件欺詐（英語：Mail and wire fraud）和誠信服務郵件欺詐（英語：Honest services fraud）。[8][9][10][11] 這些身為被告的父母不少是知名演員或著名商人。[12][13] 這些指控的刑罰最高可達10年有期徒刑（3年後方可假釋）並處罰金25萬美元。一個月後，16名家長被以「洗錢」的共謀重罪起訴。第三項起訴罪名的最高刑罰可達20年監禁（3年後方可假釋）並處罰金50萬美元。

有數個中國家庭通過辛格將子女送入史丹福大學和耶魯大學等美國名校。山東步長製藥董事長、聯合創始人趙濤支付了650萬美金（約合4377萬人民幣），將女兒趙雨思（Yusi 'Molly' Zhao）送入史丹福大學，是所有家庭出錢金額最大的[17]。另一個家庭被爆是中國公安部A級通緝令當中的嫌疑犯郭虎林支付了120萬美金將女兒Sherry Guo（郭雪莉）送進了耶魯大學。[18][19][20][21]

調查與起訴

FBI稱從2011年開始，33家長高中生與其他人合謀，利用賄賂和其他形式的詐騙，非法安排讓他們的子女考上頂尖高校。[22]

指控

聯邦檢察官指控大學入學計劃涉及：

  • 賄賂考試管理員，以方便學院和大學入學考試作弊[22][23] 。
  • 賄賂精英大學的教練和管理人員，提名不合格的申請人作為精英招募運動員，從而促進申請人的錄取。
  • 使用慈善組織隱瞞洗錢、賄賂付款的來源和性質[24]。

欺詐方式

辛格主要使用兩種欺詐手段來幫助客戶的孩子進入精英大學:

  • 欺騙大學入學考試（SAT、ACT），僱傭替考者參加考試；收買考試中心工作人員，篡改考試成績[25]。
  • 包裝客戶學生為體育特長生，製作精英體育證書，買通校體育隊教練，讓客戶學生進入校體育隊，增大入學概率[25]。

涉事方及組織

本次醜聞共計有50人涉案而被調查,[26] 這些人包括33名大學申請者的父母[27] 和11位來自八所知名大學或學院的體育教練和管理者。[13][26][28] 此外還涉及另外三所大學，但是並沒有點名或直接牽連到具體工作人員。[8][9][29]

中國家庭行賄案例

除了美國家庭行賄以外，還有數個中國家庭通過辛格行賄，將子女送入史丹福大學和耶魯大學等美國名校。

A股上市公司步長製藥創始人兼董事長趙濤支付了650萬美金（約合4377萬人民幣）送女兒趙雨思進史丹福大學，是所有家庭出錢數額最大的。趙家支付給辛格650萬美金，後者用50萬美金買通了史丹福大學帆船隊主教練約翰·范德莫爾（John Vandemoer），讓不會駕駛帆船的趙雨思以帆船運動員的身份入學。事發後，史丹福已經將趙雨思開除。[17]醜聞敗露以前的2017年7月30日，趙雨思被邀請在鬥魚直播，聲稱自己以ACT33分，托福111分的成績被史丹福大學錄取，並分享自己申請史丹福大學的經歷，聲稱「只要你有夢想朝着自己的目標去努力那就問心無愧！」。 [97][98]

此外，中國公安部A級通緝令當中的嫌疑犯郭虎林支付了120萬美金給辛格，辛格用40萬美金賄賂耶魯女子足球隊教練魯道夫·「魯迪」·梅雷迪思（Rudolph "Rudy" Meredith） ，將其女兒Cherry Guo（郭雪莉）以足球運動員的身份送進耶魯大學。事發後，耶魯已經將該女生開除[18][19][20][21][19]。

另一位中國籍家長Sui Xiaoning於2020年2月認罪，承認支付40萬美元，讓兒子偽造足球運動員身份進入UCLA[99][100]，Sui和她的兒子Eric於2015年移居加拿大，丈夫則在中國工作[101]。Sui於2019年9月在西班牙被捕並一直拘留，於2020年2月引渡至美國，被判監禁（已在西班牙服過）、沒收支付的40萬美元、並額外罰款25萬美元[102][103]。

批評與回應

為應對該醜聞，美國大學體育運動主要管理機構——全國大學體育協會宣佈將審查這些指控「以確定全國大學體育協會相關規定被違反的可能程度」。[52][104]

美國參議院財政委員會成員、美國參議員榮·懷登（俄勒岡州共和黨員）計劃提交一項議案，如果捐贈者的孩子就讀於其所捐贈的學校，那麼學校應該就其捐款部分被課稅。[105] 另外，參議員克里斯·康斯（特拉華州民主黨員）和約翰尼·伊薩克松（佐治亞州共和黨員）同意重新討論2017年的一項立法，該法案旨在針對招收低收入學生比例最低的大學或學院處以罰款。[105]

針對相關個人的行動

遭指控的教練事發後被解僱或停職，或者在被指控時已離開大學。[106] 代表學生參加考試的Mark Riddell被禁止擔任IMG學院高考準備主任，並在一周後被解僱。[107][108]

2019年3月26日，耶魯取消了與醜聞相關的學生的入學資格。[109]4月2日時史丹福宣佈他將欺詐有關的學生踢出校園。[110]以上情形的入學期間成績大部分均無效。

洛莉·路格林在被起訴後，霍爾馬克頻道停止她的節目播出。[111]根據The Hill的說法，網飛也決定將路格林從Fuller House撤下。她最小的女兒Olivia Jade也失去了與TRESemmé和絲芙蘭美容產品鏈的合作夥伴關係。但其他大多數涉案人狀況未知，但均可能面臨遭到學校逐出且可能一定期間不被錄取的情形。

法律訴訟

有人在案發後立即針對大學和個人提起多起訴訟。來自杜蘭大學、羅格斯大學和加州社區學院的三名學生向辛格和受影響的大學投訴，他們希望這些大學將被證明是集體訴訟。[112]也有人以不公平的入學來提起訴訟。史丹福大學的一名本科生因為她在醜聞中提到的學校所申請的時間和金錢而遭受損失，以及史丹福大學聲譽的污點可能會降低她學位的價值。一位家長在三藩市對所有被起訴的人提起了5000億美元的民事訴訟，聲稱她的兒子因其他父母以而賄賂方式入學而被拒絕入學。[113]

評論

醜聞爆發後，多個美國新聞來源，包括大西洋、Vox[114] 、滾石和紐約時報將其描述為大學入學制度破裂的問題[115] 。大部分新聞報導試圖解釋為什麼有人會受到辛格計劃的誘惑。這些被告的一個共同特徵是富有者，但並非超富人。

It was true that a quarter of the class went to the Ivy League, and another quarter to places such as Stanford, MIT, and Amherst. But that still left half the class, and I was the one who had to tell their parents that they were going to have to be flexible. Before each meeting, I prepared a list of good colleges that the kid had a strong chance of getting into, but these parents didn’t want colleges their kids had a strong chance of getting into; they wanted colleges their kids didn’t have a chance in hell of getting into. A successful first meeting often consisted of walking them back from the crack pipe of Harvard to the Adderall crash of Middlebury and then scheduling a follow-up meeting to douse them with the bong water of Denison."[116]
