维基赢了这场官司

来自《德国之声》的新闻：法院一名主审女法官宣布，“Tron”的父母无权要求维基删除其子的全名，理由是，名字的使用并不会侵犯当事人死亡之后依然享有的隐私权。裁决书指出，对死者隐私权的保护首先是指让死者不受谎言的侵害及不受人格侮辱，而本案并不涉及这一侵害。

强烈要求使用Boris F.的全名！！

德国法根本不适用于中文维基！在这儿叫嚷德国法纯粹是要搞治外法权！如果此先例一开，是不是以后中国法院也可以要求中文维基去掉中华民国、法轮功、九评共产党等条目？？！！另外7个版本的wiki无一例外提到了Boris F.的全名！（参见英文wiki讨论页）此事关系到自由维基的核心理想！甚至生死存亡！绝对不能妥协！！ --鸟甲 20:46:14 2006年2月9日 (UTC)

  • Mr. Attorney-at-law Friedrich Kurz ("Creative Law", cp. [4]) plead the parents' case. After the cryptic death of Boris F., who was find suspended on a tree in Berlin, the parents and family - with all the pains they have been in deep mourning because of loosing their child - the parents do not want the forwarding hyperlink be set from the german domainname http://www.wikipedia.de/wiki/Boris_F(amilyname) to the american server http://de.wikipedia.org/wiki/Boris_F(amilyname). In the context of this technical hyperlink and by forwarding german users to german spoken content is accused by a so called "abetment-disquieter" in the European Law especially by the Federal Court of Justice - as long as the complete familyname plays a role in it.
  • Responsible for the domainname WIKIPEDIA.DE is the Wikimedia Germany e.V., cp. whois at [5], a membership corporation with its domicile in Berlin intenting to make financial profit because of this case. This is the reason why the same one German Municipal Court of Berlin was called.
  • The Municipal Court of Berlin (Germany), cp. [6], filed the restraining order on January 17, 2006. The main negotiation can then be done in quiet hours while the hearing before there will exist a final decision. The restraining order itself is only a temporarily solution. Only the best lawyers are allowed to become a District Court Judge in Germany.
  • Because of ignoring the public warning of January 12, 2006, cp. [7], the Wikimedia Germany e.V. with its members - and not the Wikimedia Foundation Incorperation - is potentially responsible for damages.

A hint of sarcasm in this case is, that - instead of deactiving this only one objectinable hyperlink - the Wikimedia Germany e.V. switched off the complete german forwarding system of all the german articles at the german Wikipedia. Food enough for the press. IAAL 22:00 2006年2月9日 (UTC)

我能理解您的汉语，应该是机器翻译的，不过还行，大致明白。我不知道您所说的“大区别”有多大，为什么个人的案子我们就要尊重，政府反而就可以置之不理？原告已经诉诸法律，法院判决就是一种政府行为，和政府压制没有什么区别。而且，象中华民国这种条目得罪的的确是很多“中国人”，而不只是“中国政府”。 --鸟甲 22:47:44 2006年2月9日 (UTC)

中文维基从来没有想公开所有黑客的姓名，很多黑客还没资格上维基呢，你可以看看Wikipedia:成為維基百科傳記的標準。但要是满足这个资格，维基当然可以公开他们的姓名，别拿德国法来教训我们该怎么做，先回去好好研究一下德国法，看看德国法到底管得着什么吧！ --鸟甲 22:29:14 2006年2月9日 (UTC)

Hello! You are correct, however the chinese website of Wikipedia is also accessable in Berlin to the Court of Berlin in Germany. The parties are "Parents of Tron vs. Wikimedia". We must wait a little bit until they are finished with this case. After it, everybody knows then what will happen with the familyname. I hope, you understand this. Thank you very much. I personally have another opinion. I think, wikipedia is not a database to "outen" all hackers and crackers of the world with all their complete name. I respect your position. But my concern is that if your requirement is accepted, that will become a bad precedent that the Chinese government can also invoke. And I don't think that we need to wait for the judgment of the German case. Even though plaintiff wins, the court can still only prohibit www.wikipedia.de, a German domain name under the jurisdiction of German courts, from linking to de.wikipedia.org. This is exact the reason, why the Wikimedia is fighting for YOU in front of the Court. And they pay for YOU all the costs to get for YOU the right back. And if they say "just now NO NAME", then this is the STRATEGY to WIN a case for YOU. The problem here is, that there are crackers from Germany who WANT to make DAMAGES to YOU and YOUR wikimedia and this is why they PRESS the complete name INTO this article. Making financial DAMAGES to Wikimedia, this is the bad intention of these crackers.
Or with other words: If YOU assist these crackers, then Wikimedia will LOOSE the case because of YOU. If you are not patient, then please feel free to PAY THEM the damage and costs. 1,2 Million USD, no problemo. It is YOU if you will go along this wrong way. It is you and your family that you will be a poor man all your life long. This is also the reason why I told you, that this solution with a short name "Boris F." or "Tron" is ONLY FOR JUST NOW. The game is not over. We are 18 lawyers, we know what we do to win the case of freedom for YOU and YOUR freedom.
Secondly, what we are talking about is not about a domainname http://www.wikipedia.cn We talk about the http://zh.wikipedia.ORG and this domainname wikipedia.ORG belongs to Wikimedia Foundation and not to YOU.
